TERMS OF SERVICE


When Aaron Kho Studios offers a photography, filming, editing, designing, retouching or any media content production services (“Service”) for you, you are agreeing to the following terms:

Terms and Conditions: These Terms of Service (“Agreement”) contain the entire understanding between Aaron Kho Studios (“The Owner”) and the Client (“You, Your”), and they contain information on generic terms and conditions that applies to all services offered for Aaron Kho Studios. Should you book a service with Aaron Kho Studios and were offered a contract agreement (“Contract”), the Contract will supersede the terms and conditions in this Agreement henceforth mentioned. Should clauses within the Contract lack mention of specific items in this Agreement, the terms and conditions listed in this Agreement will apply to the Contract. Should you book a service with Aaron Kho Studios and was not offered a Contract, this Agreement shall apply to your booking. The terms of service may be changed without further notice. And you are encouraged to periodically visit this page to review the most current Terms and Conditions to which you are bound. This Agreement does not supersede all prior and simultaneous Contracts made between the parties. 

Payment & Prices: All costs are as stated at the time of booking & will remain once booking is confirmed. The stated cost amount is due at the time of booking unless otherwise stated. Upon your purchase, The Owner will reserve the time and date agreed upon, and will not make other reservations for that time and date. For this reason, any pre-payment made is non-refundable. 

Should you require The Owner to provide an invoice for services rendered, please request The Owner in writing (via email or via text) at least 7 days prior to the date when the first service is rendered. Payment terms via an invoice is only available for Corporate and Enterprise clients. And the full amount must be paid within 30 days from the date of the invoice issued. 

In the event where the full amount is not paid by the deadline, The Owner may take down or withhold the images from being published and charge a 10% interest of the total amount every 14 days for the lack of payment past the deadline. You should take every possible mean to communicate with the Owner and provide a reasonable expectation if you could not make the payment deadlines. 

Reschedule: Due to the time specific nature of this service, you may reschedule but will be subjected to the Owner’s availability to commit to another available time. Should there be no other time the Owner will be available to provide the service, all pre-paid amounts will not be refunded. Should inclement weather prevent the Owner from providing the expected services and rescheduling be required, you will have to pay for extra transportation and service cost should additional hours be required for the service(s). The cost is determined by the extra hours required for the Services to be rendered.  

Artistic Style:  You acknowledge that you have viewed examples of previous work and are satisfied with the overall style of photography that is presented. You understand that differences in locations, subjects and lighting allow for variations in the final outcome of the Session. There is no knowing what photos will be produced from this endeavor simply because this is an event in the future. The Owner reserves the right to artistically interpret how to photograph a scene. This may mean that some shots are color and some may be black and white. 

Copyright & Reproductions: The Owner owns the copyright to all images, videos and footages (“Contents”) created during the and shall have the exclusive right to make reproductions. The Photographer maintains the right to make reproductions for the Client or for the Photographer’s portfolio, self-promotions, entry in photographic contests or art exhibitions, editorial use, or for display within or on the outside of the Photographer’s studio.  

For Corporate and Enterprise Clients, You understand and agree that the Contents you receive from my service is only a license to use and not the entire copyright to the Contents. The term of license begins from the date the Owner receives full payment of invoice and upon delivery of the images and if not stated in the Contract, ends in 1 year / 365 days.

The use of any Contents by Client will not constitute a work of joint authorship. And unless otherwise agreed, any rights granted are always non-exclusive, non-sub-licensable and non-transferable.  

Photographer: The Owner may substitute another photographer to take the photographs in the event of Owner’s illness or personal crisis. In the event of such substitution, The Owner warrants that the photographer taking the photographs shall be a competent professional.

Reshoots: If Client requires a reshoot, Client will pay The Owner an additional fee of one hundred percent of the fee stated in the quote or invoice for the original shoot, plus all expenses for the reshoot. If a reshoot is required due to factors beyond the control of The Owner, including but not limited to, weather conditions, or acts of God, The Owner will not charge an additional fee and Client agrees to pay all expenses for the reshoot.

Cooperation & Physical Liability     All parties agree to cheerful cooperation and communication for the best possible result within the definition of this Assignment. The Owner is not responsible for missed images due to any individual’s failure to appear or cooperate during the Assignment. If there is any threat to the Owner or their equipment by any subject, The Owner reserves the right to end coverage immediately with no further liability to finish the Assignment, with no refunds given. Additionally, you are responsible for their own conduct and the conduct of all participants in the Session. Any damage to equipment or studio components caused by the Client are the sole financial responsibility of the Client. Client agrees to hold Photographer harmless for any injuries or damages sustained preceding, during, and immediately following the Assignment.

Limit of Liability: In the unlikely event that the Owner cannot perform this Agreement due to a medical or natural emergency, or other cause beyond the control of the Owner, then the Owner shall return the monies to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Owner fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.
